Oz Blinds makes no representations or warranties of any kind, express or implied, as to the operation of the site or the information, content materials or products included on the site. To the full extent permissible by applicable law, Oz Blinds disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. In no event shall Oz Blinds be liable for any damages of any kind arising from the use of this site, including, but not limited to, direct, indirect, incidental, punitive and consequential damages. In addition to this, Oz Blinds reserves the right to refuse service and/or cancel orders at its discretion including, without limitation, if Oz Blinds believes that customer conduct violates applicable law or is harmful to the interests of Oz Blinds. By placing an order and providing payment, you are entering a binding contract between yourself and Oz Blinds and you are agreeing to abide by these Terms and Conditions. Once you make a purchase and receive a delivery of your blinds, the blinds cannot be returned due to dissatisfaction with the colour/quality/texture of the material unless you first ordered samples and your product is significantly different from the colour sample you received. All Blinds are made square and no responsibility can be taken for "out of square" windows.

Warranty

Oz Blinds sells Australian Custom Made Blinds as well as International Custom Made Blinds.

All Australian Custom Made Blinds are covered by 1, 2, 3, 5 or 10-Year Factory Warranty and all International Custom Made Blinds are covered by a 3-Year Factory Warranty. We are very confident in the quality of the product that we are selling, so we warrant that our products will be free from defects in material and workmanship for this period of time. If a warranty claim ever arises, just contact us so we can organise a repair or replacement. Colours vary from lot to lot and may not exactly match sample purchases. Child Safety

WE TAKE CHILD SAFETY VERY SERIOUSLY. IT IS A CONDITION OF SALE THAT ALL CHILD SAFETY DEVICES AND CORD TIES MUST BE FITTED TO ALL BLIND CORDS AND CHAINS.

Prices, Payment Options and GST

Prices listed on the Oz Blinds website or documentation issued by Oz Blinds is in Australian dollars. We accept Visa, MasterCard, PayPal and Direct deposit. To be able to make a purchase through Oz Blinds website you must be over the legal age of 18 years old. Only then we will accept your order. In the case that fraud happens and the person who is a minor makes a purchase or purchases while falsely declared himself or herself as a person of legal age, we Oz Blinds in that case reserve the right to hold parents or guardians of the minor who has placed the order with us, responsible so the money and the cost of the purchase price as well as other associated costs, if any, can be retrieved to cover the cost incurred by us (Oz Blinds). In addition to this, the person who is making the payment for the purchase of blinds must be the person who is authorised to use the Credit Card for which the details have been provided or to pay via Direct Debit or PayPal. All orders are paid for when your order is placed unless you have decided to pay via Direct Debit. If you have decided to pay via Direct Debit, we will send you Tax Invoice with payment instructions. Your order WILL NOT be processed before we receive your payment and the money has cleared the bank. In some cases, coupon discounts may be offered via coupon codes. Only one coupon code may be used per order. All prices displayed on our website are GST Inclusive.

Fabric Pattern (texture) and Fabric Colour Disclaimer:

Oz Blinds cannot guarantee that your computer monitor/tablet/mobile phone display will give you a true representation of the Fabric Pattern or the Fabric Colour. We offer our customers the option to order fabric colour samples before placing any orders with us. By ordering the fabric colour sample, the customer can be sure that the chosen fabric pattern, as well as the fabric colour, is what they wanted to purchase. In the case where the customer places the order without previously purchasing the colour samples, and the customer does not like the colour or the texture of the final product that he has received, Oz Blinds cannot and will not be responsible to offer any compensation to the customer or to manufacture the new blinds in a different colour, because the customer has failed to order the fabric colour sample before they have purchased the blinds from Oz Blinds website. Please note: Colours vary from lot to lot so we cannot guarantee that purchased fabric samples will be the exact match to the purchased blind fabric. Once you receive your fabric sample and if you are happy with it and wish to order your blinds, keep in mind that all samples may still have minimal colour variations from the final product as the dye lot variations can appear, as stated by the manufacturers. We would like to suggest that you order all of your blinds of a chosen fabric pattern and fabric colour at one time to ensure that the same batch is used.

The photos of the fabrics for “Light Filtering Blinds” that are on our website, do not show you the effect of back lighting, which can soften the actual colours and can or will highlight fabric textures. To see how back lighting affects the colour or texture of a particular material, make sure you order a fabric sample from us.

Cancellations, Changes and Refunds

Oz Blinds only sells products that are custom made to your exact specifications. These products are not suitable for resale or restocking so we cannot accept returns. It is important that you are sure of your purchase decisions prior to finalizing your order. No refunds are permitted in the event that the customer is simply unhappy with their purchase or has changed their mind. We automatically charge your credit card for the total sale price, including shipping, immediately after you complete your online order. If you need to change or cancel your order please contact us immediately or at the latest by 5 PM the following business day. We can only accept this time frame as after this time frame your custom made blinds will begin to be manufactured so no order can be cancelled or adjusted. We cannot refund money or issue any credits for a credit card purchase if the cancellation or change occurs at any time beyond this period. For your convenience, we can be contacted from Monday to Friday, 9 AM to 5 PM. In an unlikely event where we cannot fulfil your order due to the shortage or unavailability of the chosen blind, fabric or colour, we will contact you immediately to suggest a suitable replacement or to cancel your order and offer you a refund. The maximum amount for which Oz Blinds can be liable for shall under no circumstances exceed the amount paid by the customer for the product, inclusive of the postage and handling.

In addition to this, the case where your payment is declined by your financial institution or in an unlikely event where the purchase price of blinds that you have purchased was incorrectly displayed on our website, whether due to the human or technical error, Oz Blinds reserves the right to cancel your order and will not be liable to offer you any compensation for any pain or suffering caused by the cancellation. If we do cancel your order we will refund the purchase price back to you and you will be notified via email as soon as possible. We also reserve the right to reject any order that is placed through our website, at our discretion.

Discontinued Fabrics or Fabric Colours:

Sometimes fabrics or certain fabric colours get discontinued by the manufacturers we work with. We will make every effort to remove discontinued fabrics or fabric colours from our website, as soon as we are made aware of them being discontinued.

Delays

There could be occasions where we could experience some delays caused by public holidays, holidays, out of stock materials, possible shipping delays or some other factors that are beyond our control. If this happens and the manufacturer contacts us, you will be contacted that same day.

If you live outside capital cities or regional centres, please contact us before you place an order to get a quote for a delivery to your place of residence. In the case where you place an order and your place of residence is outside capital cities or regional centres, we reserve the right to contact you and clarify the cost of delivery to your place of residence. In the event where extra charges do apply and the purchaser refuses to pay the extra fee for the delivery, Oz Blinds reserves the right to cancel that order and to refund the money to the purchaser, without being liable to offer any compensation for any pain or suffering caused by the cancellation.

Delivery Time Frame

COVID DELIVERY TIME UPDATE:

Currently, due to Covid isolation issues, our manufacturing time for most blinds is longer than usual and it stands at 16 - 24 working days + delivery time. Usually, that is significantly lower.

NORMAL DELIVERY TIMES:

On average, it takes approximately 3-5 working days to manufacture + 3-5 working days to deliver Express Blinds, 16 - 24 working days to manufacture and deliver Australian Made Blinds and 16 - 24 working days to manufacture and deliver International Made Blinds. We always strive to keep these times correct, but sometimes there are factors beyond our control that will directly impact the delivery time and we cannot be held responsible for that. (Read: Australian Customs, Freight Company delays/mistakes, Fabric Manufacturers etc…)

BLINDS DELIVERY WHILE YOU ARE NOT AT HOME

All deliveries will take place between the hours of 9-5 Monday to Friday. If you know that you will not be at home to accept your order's delivery, between the hours of 9-5 Monday to Friday, we can arrange for your blinds to be delivered to an alternative address where you know that someone will be there to accept your delivery (Friend, neighbour, your place of work, etc…) In the case you did not provide us with an alternative address and you are not at home at the time of delivery, delivery driver has the option to deliver and leave your blinds at your property unattended or to leave "sorry we missed you card" so you can arrange a new delivery time or in some instances to go and pick up from your nearest depot. Please note that some freight companies give you an option to go and pick up your blinds from them, while other freight companies do not provide this service.

IMPORTANT: As all our orders are delivered with “Authority To Leave”, in the case that delivery arrives and there is no one to accept your delivery, the driver may deliver and leave your order unattended at your specified delivery address under “Authority To Leave” rule. Should your blinds be damaged or stolen while sitting at the delivery address unattended, Oz Blinds cannot and will not be held responsible to offer you any compensation or to supply you with new blinds as a result of damage or theft.

If blinds are left unattended and not signed for, as there was no one to accept delivery, we will not accept responsibility or claims for any damages that blinds could have sustained while they were left there unattended or if they get stolen after being delivered to your nominated place of delivery.

IF YOU ARE ORDERING A “MIX” OF AUSTRALIAN MADE AND INTERNATIONAL MADE BLINDS DUE TO THE FACT THAT THEY ARE COMING FROM TWO DIFFERENT FACTORIES WE HAVE NO CHOICE BUT TO CHARGE TWO DELIVERY FEES.

Please Note: All International made blinds will be delivered to your nominated delivery address with "Authority to leave if no one is at home" otherwise known as "Authority to leave if Unattended". If you don't want this to happen, please nominate the address, at the time of purchase, where you are certain that someone will be there to accept delivery of your order. On average, it takes approximately 10-17 working days for Australian Made Blinds and 10 - 17 working days for International Made Blinds to be manufactured and delivered to you. We always strive to keep these times correct, but sometimes there are factors beyond our control that will directly impact the delivery time and we cannot be held responsible for that. (read: Australian Customs, Fabric Manufacturers etc…)

If you are unable to be at home to accept delivery, we can arrange for your blinds to be delivered to an alternative address. (Friend, neighbour, etc…) In the case you did not provide us with an alternative address, and you are not at home at the time of delivery, the delivery driver will leave you the address of their nearest depot where you can go and pick up your blinds from (this is if depot pick up is available - not all freight carriers have depot pick up available).

Please note that the purchaser has 7 days for Australian Custom Made Blinds and 2 days for International Custom Made Blinds from the date they receive their blinds order to notify Oz Blinds if they are missing any blinds, blinds parts or any other portion of their order. If within the period of 7 days for Australian Custom Made Blinds and 2 days for International Custom Made Blinds, the purchaser fails to notify Oz Blinds that certain things are missing, we at Oz Blinds will consider that the order has been 100% delivered to the purchaser.

Delivering Outside of Australia

No orders for delivery outside of Australia will be taken.

Freight Damages

It is highly recommended to inspect all blinds for damage. If there is damage than all the damages need to be reported to us and any damage that is not reported to us will not be eligible for a repair or remake free of charge. There is a 5 day period, from the moment you take possession of your blinds, to report any damaged or unusable blinds so they can be replaced. If upon arrival, the blind box is visibly badly damaged, then delivery of that blind box should be refused and reported to us immediately. Once Oz Blinds has received the damaged goods we will immediately repair or remanufacture your blinds. Attempt to install blinds that have been damaged in delivery will void any warranty claim. If within the period of 5 days of you receiving the blinds, you fail to notify us that your blinds are damaged, we will consider that the blinds were delivered in a 100% good order. If the claim arises after the 5 day period, we will not and cannot be held responsible for the replacement of the damaged blinds or the associated costs that comes with replacing them.

Hardware Included

Blinds come with all the hardware except the screws. This is due to the fact that different screws are needed in different applications and we are not aware of the type of surface where you will be mounting your blinds. In most timber applications 7G 25mm screw is appropriate for blinds and 4G or 6G 15-25mm screw for chain safety clip, but the exact screw length, screw head size and type of screw will vary depending on whether you are mounting your blinds into drywall, wood, concrete or metal. If there are no screws with your order you will need to purchase some. Rule of thumb is 2 to 3 screws per bracket and 2 or 3 brackets per blind (sometimes there are more brackets per blind and this depends on the type of blind you have ordered and the blind width).

Product Errors, Incorrectly Filled or Defective Orders

We provide you with the measuring instructions as well as installation instructions so it is very important that you follow these instructions so you can achieve the perfect fit. If our instructions are followed, then blinds purchased from Oz Blinds website, will fit your windows perfectly, guaranteed. If it happens that we make a mistake while placing your order, we will repair or replace your blind(s) at no charge to you. In the case that you make a mistake in measuring or ordering your blinds, please contact us as soon as possible so we can try and correct your order before it enters the manufacturing stage. If the blinds have entered the manufacturing stage then we cannot do anything about it. Oz Blinds cannot be held responsible if we fail while trying to solve the problem caused by you. As we sell blinds that are custom made to your exact window sizes, these custom made blinds cannot be returned for replacement or exchange. In the case where the blinds that you have received are not of the size, colour, fabric, type as you have ordered, please contact us immediately so the origin of the error can be established and the replacement or repair, if the fault has been made by us at Oz Blinds, can be organised. All the repair cost or the cost of replacing the blinds, if we establish that the purchaser has made a mistake while ordering, will be at the expense of the purchaser, inclusive of the redelivery and delivery cost.
